Pagamentos de diárias em ascensão, programas que se assemelham a um trem da alegria, gastos com passagens aéreas, publicidade e eventos que somam milhões de reais, aumento da assessoria direta do presidente. Exemplos de práticas já descobertas em inspeções nos Tribunais de Justiça do País agora atingem também o Conselho Nacional de Justiça (CNJ), criado para exatamente para coibir hábitos como esses e melhorar a administração do Judiciário.
Em oito meses, o CNJ aumentou em 60% as despesas com passagens e ampliou a listagem de gastos com festas e homenagens, como coquetéis, almoços e posses. Os ‘convescotes’, palavra usada por um conselheiro e por um servidor, criaram despesas superiores a R$ 685 mil neste ano, mais de cinco vezes o que o Supremo Tribunal Federal (STF) gastou no mesmo período com a mesma rubrica.
Uma análise das despesas revela casos como o da psicóloga que viajou para o Chile com tudo pago pelo CNJ para estudar o sistema criminal do país. Nem mesmo seus colegas souberam explicar o que exatamente ela foi fazer lá. Ou ainda o exemplo do programa do conselho que, após uma série de despesas, mudou de nome. A alteração, segundo servidores do CNJ, serviu para zerar o orçamento e apagar o rastro de gastos milionários que foram feitos sob a outra rubrica.
Casos como esses mostram por que os gastos com diárias e passagens do CNJ superam o que o órgão despende hoje com pagamento de salários. Dados do Siafi dos oito primeiros meses do ano, obtidos por intermédio da ONG Contas Abertas, mostram que as despesas do CNJ com diárias no Brasil e no exterior superaram R$ 3,1 milhões, 21% a mais do que foi gasto no mesmo período de 2010. Com passagens aéreas, o conselho gastou nesse mesmo período mais de R$ 1,6 milhão, 60% a mais do que no ano anterior.
A soma desses gastos é maior do que as despesas deste ano do CNJ com o pagamento de vencimentos e salários – R$ 4,1 milhões, conforme dados oficiais. O que o conselho gastou em 2011 só com passagens aéreas é quase o dobro do que foi investido de 2008 a 2010 nos mutirões carcerários, conforme dados da gestão de Gilmar Mendes.
‘Auxílio-sessão’. Esses números do Siafi e dados do próprio CNJ revelam que, além do salário – que varia de R$ 22,9 mil a R$ 27,7 mil -, os conselheiros recebem uma espécie de ‘auxílio-sessão’, conforme levantamento feito no site do conselho.
Eles receberam diárias e passagens para ir a Brasília participar das sessões de julgamento. Mesmo os que se afastaram de suas atividades para se dedicar exclusivamente ao conselho ganham os benefícios. Os números do próprio CNJ revelam que esses extras e as constantes viagens permitem que um conselheiro receba em um mês o equivalente a R$ 28 mil em diárias.
O campeão nesse ranking recebeu, neste ano, o equivalente a R$ 10 mil por mês nas viagens que fez pelo Brasil, seja para missões do CNJ, participar de eventos ou proferir palestras. Eventos que nem sempre, segundo servidores, são revertidos para os programas do conselho.
Para compensar gastos como esses, a secretaria-geral da presidência do CNJ tenta conter despesas de outros órgãos do colegiado, como a Corregedoria Nacional. Situação que criou rixas e conflitos entre presidência e corregedoria e acusação de lado a lado de quem seria o real responsável pelo aumento de gastos.
Dados da corregedoria mostram que ela respondeu por apenas R$ 832 mil dos R$ 3 milhões gastos com diárias. E que apenas com um de seu programas conseguiu devolver aos cofres públicos cerca de R$ 176 milhões, valores que envolviam processos do Sistema Financeiro de Habitação (SFH) que estavam parados no Judiciário.
Inchaço. O aumento de gastos também ocorreu no comando do CNJ. Durante sua gestão – até abril de 2010 – Gilmar Mendes convocou seis juízes para auxiliá-lo no exercício da presidência. Cezar Peluso, atual presidente do conselho, convocou 13 juízes para desempenharem a mesma função. Cada um recebe uma passagem aérea do tribunal para retornar ao Estado de origem, além de auxílio-moradia e do próprio salário.
Mais cadeiras
Dois servidores do CNJ contam que, com o aumento da estrutura da presidência, foi preciso buscar espaço para acomodar os novos juízes. ‘Não tinha cadeira para todo mundo’, disse um deles.
Mais antiético não foi apenas o uso de um motorista pelo ex-ministro Pedro Novais???
