Em resposta à nota emitida pela AMMA (Associação dos Magistrados do Maranhão), que repudiou a atitude da OAB/MA de divulgar, em seu portal, matéria informando da notificação à juíza do 6º Juizado Especial Cível e das Relações de Consumo de São Luís, Lucimary Castelo Branco Campos dos Santos, o presidente da Seccional maranhense da Ordem dos Advogados do Brasil, Mário Macieira, reagiu: “Lamentável mesmo é o corporativismo da Associação dos Magistrados, verbalizado por alguém que já ocupou a honrosa cadeira da presidência da OAB/MA e deveria conhecer e respeitar as prerrogativas legais do advogado”.
ENTENDA O CASO – A notificação foi enviada, no mês passado, pelo presidente da Comissão de Defesa das Prerrogativas da OAB/MA, Carlos Sérgio Barros, em defesa da advogada Márcia Regina dos Reis Cruz que, ao comparecer em uma audiência e não aceitando a proposta de acordo da parte contrária, teria sido moralmente constrangida pela juíza, ao afirmar que “advogado apenas serve para atrapalhar o andamento processual”. A juíza teria mencionado ainda que, caso a advogada não aceitasse o acordo, a sentença poderia ser arbitrada em um valor inferior ao que foi proposto.
As declarações da juíza, transcritas na própria nota da AMMA, já deixam evidente o desrespeito à advogada:
1) “Apenas disse que a sua intervenção deveria ser na fase de instrução,” – não fosse a presunção de conhecimento jurídico de uma juíza, a frase revelaria que a magistrada desconhece, ou solapa, a prerrogativa do advogado de patrocinar, com ampla liberdade, os interesses do seu constituinte, inclusive na fase de conciliação;
2) “sua insistência em querer um valor maior estava prejudicando o acordo” – outra declaração atribuída pela AMMA à juíza que diz muito quanto à violação das prerrogativas, visto que o advogado não só pode, como deve, orientar seu cliente sobre as vantagens e desvantagens de um acordo, sendo dever do juiz respeitar o trabalho do advogado e preservar sua imparcialidade;
3) “em momento algum a impediu de falar, embora a advogada estivesse tumultuando a audiência” – O que a juíza qualifica como tumultuar a audiência? Qual foi o ato específico praticado pela advogada que possa ter tal pecha? A declaração é vazia e típica de autoridades que, não entendem, não desejam ou não respeitam a atuação profissional do advogado.
“Da mesma forma que o presidente da AMMA apóia a Juíza, embora sem razões de direito, a OAB/MA reitera, reafirma e não recua na sua posição de defesa das prerrogativas profissionais, definidas em Lei – lei à qual, num Estado de Direito, todos estamos submetidos, mesmo as pessoas investidas, circunstancialmente, da autoridade estatal”, enfatizou o presidente da OAB/MA, Mário Macieira.
