Parabéns ao TJ por ter suspendido a cobrança do IPTU, numa reunido em sessão extraordinária tarde desta quinta-feira (26). Mas uma pergunta não pode calar: Ficou claro nas declarações do promotor Osmar que houve fraude nos livros atas que deram sustentação a esse aumento abusivo, com isso devemos acreditar que tudo ficará esquecido com a suspensão pelo TJ? Caso aconteça isso, podemos dizer que a impunidade no Brasil é o maior estimulador aos de corrupção, de fraudes, irregularidades!!!
O Pleno deferiu, em caráter liminar, medida cautelar em Ação Direta de Inconstitucionalidade (Adin) ajuizada pela seccional maranhense da Ordem dos Advogados do Brasil (OAB) contra a Lei Municipal 3.392/2010, que instituiu o aumento da Planta Genérica de Valores (PGV) – base do cálculo do imposto -, alterando os valores a serem cobrados este ano,
O procurador afirmou que o Ministério Público não exclui a possibilidade de ingresso – com base em outros fundamentos – de outra Ação Direta de Inconstitucionalidade contra a lei que institui o aumento na cobrança do IPTU. Isso não dar por fim esse caso. O MPE tem por obrigação abrir uma investigação mais apurada e punir aqueles que armaram essa patacoada contra o povo.
Dos 24 desembargadores, 14 acompanharam o relator pela concessão da medida cautelar e três se posicionaram contra. Cinco desembargadores não estavam presentes: Jorge Rachid e Stélio Muniz – em férias – Antonio Guerreiro, Buna Magalhães e Froz Sobrinho, ausentes justificadamente. O presidente não votou.
O efeito da medida liminar concedida pelo TJMA beneficiará todos os contribuintes do município de São Luís, que não serão obrigados a realizar o pagamento do IPTU até o julgamento do mérito da ação.
Impunidade não!!!
