O MA é um dos Estados onde a Justiça é corrompida ao extremo, havendo uma incrível aliança entre os poderes executivo, legislativo e judiciário, como dizem, uma mão lavando a outra, cadê a liberdade de imprensa defendida de forma tão aguerrida pelo pig.

Walter, o MA é uma terra à parte. Destituído de uma educação de qualidade, fica lá, ninguém gosta de meter o bedelho, o povo foi abandonado dança, nem parece que faz parte do Brasil, tá mais prá Haiti, um pouco de Jamaica, alguma coisa doutro mundo.

OK, Avatar, mas seria preciso termos informações precisas sobre o assunto. Se não, começamos julgando e só depois vamos apurar. Exemplo: a condenação de DSK, pela mídia e pelo mundo, antes mesmo de se saber a verdade. Ele é mulherengo e sem limites? Dizem que sim. Então, atacou a moça? Essa é uma matéria factual, que pode ou não ser verdadeira. Da mesma forma, o sr. Hostilio foi injustiçado? Precisamos de dados adicionais para saber isso. Se sim, merece nossa defesa intransigente. Se não, não merece. Com isso, o que defendo não é só justiça. É também jornalismo. Primeiro, os fatos, depois, os julgamentos. Essa sequência é um pouco ingênua (a apuração dos fatos já inclui certos julgamentos prévios), mas sem a tentativa de separar isso não há justiça, nem há o que pode ser decente no jornalismo.

Professo Janine, muito obrigado pela resposta, compreendo que devamos ser comedidos sim, e poderíamos acompanhar este caso até o seu desfecho final. É que a situação do judiciário maranhense é grave, de forma que este caso tratado na sua postagem não é isolado e sim parte de um esquema instalado há anos no MA. Quando vou àquele Estado, do qual gosto muito, deparo-me com situações escabrosas envolvendo o Judiciário. Alguns links:

Em matéria publicada na edição do Jornal Pequeno do dia 3 de junho de 2007, cujo título “Ex-diretor de jornal de Ricardo Murad é condenado à prisão” fica nítida a estreita e antiga ligação entre o deputado Ricardo Murad e seu fiel escudeiro Caio Hostílio.
“A juíza Ana Célia Santana, da 3ª Vara Criminal, condenou a um ano de detenção (“que torno definitiva à falta de atenuantes, agravantes ou causa de diminuição de pena”) o professor Hostilio Caio Pereira Costa, ex-diretor do extinto jornal Veja Agora, cujo proprietário era o atual deputado estadual Ricardo Murad.
A juíza condenou o “professor Caio”, após julgar queixa-crime ajuizada pelo então deputado estadual Aderson Lago, em 2005. O parlamentar teve sua honra denegrida através de textos inverídicos, caluniosos, ofensivos e sem provas, assacados contra ele pelo réu, através da coluna jornalística “Metendo o Bedelho”, com o título Sem escrúpulos e venal, assinada pelo professor Caio. Fiquei com a imprenssão de que o blogueiro não se defendeu e deixou o processo rolar. Pareeu-me que foi por falta de recursos financeiros, mesmo, e que acreditou que seria condenado apenas a tirar o blog do ar.
Achei curioso que nenhum dos dois juízes tenha convertido a pena de prisão em cestas básicas ou trabalho comunitário. Pelo contrário, o segundo juiz já aumentou em 1/3 a pena sem ter fato novo.
Mais ainda, nenhum dos juízes seguiu o preceito do equilíbrio econômico do réu nas decisões. Os valores arbitrados de R$ 100 mil reais são mais de 6 vezes superiores às impostas à revista Veja e à Editora Abril quando eventualmente condanadas.
Sem saber se o blogueiro cometeu realmente crime ou se está sendo perseguido, pode-se dizer que a retirada do blog do ar e a divulgação de um direito de resposta estaria de bom tamanho a princípio. Em caso de indenização, um valor compatível com a renda do blogueiro seria o óbvio: talvez algo menor que 15 mil reais, tendo as condenações à Veja como parâmetro.
Em suma, por tudo isso, dá para se levantar duas hipóteses mesmo se o blogueiro for culpado por calúnia: ou houve realmente extrapolação da pena ou o blogueiro relevou a defesa e acabou deixando o juiz agir somente sore influênica da acusação. As duas hipóteses seriam facilmente revertidas em 2a instância se ele levar a sério o processo, com a suspensão das penalidades já aplicadas.
