Tenho sido incansável na cobrança de agilidade por parte do Ministério Público para ingressar na Justiça contra o aumento abusivo e a fraude no IPTU cobrando pela Prefeitura de São Luís.
Ontem, devo reconhecer e parabenizar o Ministério Público do Estado, que deixou a política interna para agir em favor da população de São Luís, que estava sendo saqueada pelos aumentos de mais 8000%, em alguns casos, no IPTU. Parabéns! É assim que os maranhenses gostam de ver o Ministério Público.
Foi providencial a procuradora-geral de Justiça, Fátima Travassos, ter anunciando que o MPE ajuizou, ontem, uma Adin (Ação Direta de Inconstitucionalidade) contra a cobrança do IPTU.
Na ação, o Ministério Público alega que a Prefeitura de São Luís violou o princípio da segurança jurídica, a falta de participação popular e das associações representativas na discussão da nova Planta Genérica de Valores (PGV).
“Dentro da margem de segurança jurídica e com base no desrespeito às Constituições Federal e Estadual, o Ministério Público se posiciona com responsabilidade jurídica e social contra a não participação da sociedade no processo de reavaliação dos valores estipulados para o IPTU/2011. A Adin ajuizada pelo MP visa proteger os direitos e os interesses da sociedade”, afirmou Fátima Travassos.
Mas vale ressaltar que se o Ministério Público tivesse agido mais rápido, a Prefeitura não teria gastado tanto dinheiro do contribuinte com propaganda, coisa que gerou custos altíssimos, que poderiam ser aplicados na buraqueira. É preciso que o MPE reconheça sua demora e que isso sirva de exemplo, para o principal órgão de defesa do povo.
Por outro lado, esse ingresso do MPE contra a Prefeitura, caso seja provado às ilicitudes, o prefeito João Castelo estará passivo de um impeachment, pois fica provado à improbidade administrativa e, com isso, a Câmara de Vereadores terá que agir, caso contrário estará conivente com a fraude, a improbidade e a tentativa de saquear do contribuinte.

Não é por menos que a sociedade já não acredita mais em instituição como o judiciário, tribunal de contas, ministério público, controladoria ou algo que o valha.
A justiça só faz alguma coisa na base do “mutirão”, o ministério público assiste passivamente os desmando e não toma providências em tempo hábil, o tribunal de contas fica imerso na politicalha e não cumpre com o seu papel de acompanhar a boa aplicação do dinheiro do contribuinte, e quando faz alguma coisa é motivado por questões política partidária, do tipo que “condena” um mal gestor por atos praticados há dez, quinze anos, a controladoria é inoperante, pois todo mundo faz o que bem entende e nenhuma providência é tomada e o resto dispensa comentários.
Devia ter um pouquinho de cerimônia a presidente do MPE, de só agora vir a público dizer que fez alguma coisa contra as arbitrariedades do prefeito.
Quanto descaso, quanta falta de vergonha… Lamentável.
