A prefeita de Timon, Socorro Waquim foi condenada pela justiça por ato de improbidade administrativa relacionado a contratação da fundação João do Vale para a realização do concurso público de nível fundamental e médio realizado em 2007. A decisão é do juiz da 4ª Vara, Simeão Pereira e Silva [foto ao lado], e atinge ainda os funcionários Roberval Marques da Silva, Mikaela Oliveira Cabaral, Kleiton Assunção Martins e Evilene do Nascimento Monteiro, ambos membros da Comissão Permanente de Licitação da Prefeitura.
A condenação é fruto de uma Ação Civil Pública impetrada pela promotora do patrimônio, Selma Regina Martins ainda em 2009, onde denunciou a dispensa de licitação na contratação da Fundação João do Vale para a realização do concurso. No certame, segundo a ação, o município praticou o que se chama de renúncia de receita, onde o dinheiro arrecadado com as inscrições dos candidatos foram utilizados pela fundação nas despesas com o concurso. Os milhares de reais que sobraram também ficaram com a João doa Vale.
Em conversa com o blog do Elias Lacerda na manhã desta quarta-feira (1º), a promotora Selma Regina Martins contou que a fundação João do Vale arrecadou cerca de 801 mil reais com as inscrições, número astronomicamente superior ao que gastou no concurso. Para se ter uma idéia, a Fundação Carlos Chagas, renomada instituição realizadora de concursos em todo o Brasil, cobra em média cerca de 200 mil reais para realizar um concurso. “O que nós deduzimos é que em Timon pode ter sido realizado o concurso mais caro do mundo”, avalia a promotora.
Além da renúncia de receita que é incompatível com o discurso do governo que costumeiramente reclama da falta de recursos, a promotora observou que um dos principais diretores da fundação João do Vale, professor Eliésio Campelo Lima, é aliado político da prefeita Socorro Waquim, onde foi candidato a vereador pela coligação que apoiou a prefeita de Timon.
Não bastasse isso, Eliesio mais tarde foi assessor do gabinete da prefeita e depois assessorou a Secretária Municipal de Educação, Sueli Almeida, que é irmã da prefeita.
A condenação
A sentença do juiz Simeão Pereira e Silva foi publicada hoje no site do Tribunal de Justiça e institui à prefeita socorro Waquim e os membros da comissão de licitação da prefeitura Roberval Marques da Silva, Mikaela Oliveira Cabral Costa, Kleiton Assunção Martins e Evilene do Nascimento Monteiro a perda da função pública, suspensão dos direitos políticos pelo prazo de seis anos e proibição de contratar com o serviço público.
A sentença do juiz cabe recurso junto ao Tribunal de Justiça do Maranhão.

Fazendo um esforço enorme para livrar a cara da prefeita Socorro Waquim, o procurador récem demitido da Prefeitura de Timon, advogado Éder Claudino, disse hoje(02) pela manhã que foi afastado porque suas ações “estavam incomodando pessoas que têm interesses escusos” na assessoria da prefeita, embora não tenha citado nomes dos que vêm surrupíando os recursos públicos que ajudaram a levar a cidade a um caos administrativo.
Éder Claudino deu esta declaração durante entrevista ao radialista Márcio Beckman, da Timon FM, também para se defender das acusações dos assessores da prefeita – os que têm interesses escusos, que não são poucos – de que ele havia sido demitido por incompetência.
O procurador Éder foi demitido – juntamente com toda a sua equipe, incluindo o vice-procurador Luis Geraldo – dois dias depois da prefeita Socorro Waquim ter levado a segunda condenação da justiça local por descumprimento de ordens judiciais para o cancelamento de um concurso fraudulento que ela promoveu no final de 2007.
Os assessores de interesses escusos da prefeita ficaram revoltados porque o então procurador Éder Claudino não havia comparecido à audiência no fórum local, na semana passada, na qual foi condenada por ter renunciado ao dinheiro arrecadado pela Fundação João do Vale, que promoveu o concurso.
Éder Claudino explicou, durante entrevista à rádio, que não pode restar presente a mais este depoimento da prefeita à justiça por dois motivos; primeiro estava proibido pelo Tribunal de Justiça do Estado de defender a prefeita – como procurador ele só pode defender a Prefeitura e não a prefeita em si – e, segundo, encontrava-se em São Luis cumprindo o seu papel de represeentar o Município em outra questão judicial.
Certeza da impunidade
Responsável pela crise instalada no setor jurídico da Prefeitura em razão das ações que tem movido contra os desmandos da prefeita Socorro Waquim, a promotora Selma Regina Martins disse que nesta caso ela foi condenada porque não poderia renunciar a receita da Prefeitura em benefício da Fundação João do Vale, que pertence ao seu aliado o suplente de vereador e assessor Eliésio Campelo. Somente dos concursos de nível médio e superior, que foi cancelado pela Justiça e não respeitado pela prefeita, ela abriu mão de mais de um milhão e 300 mil, o que é um absurdo para uma cidade em que a população sofre com a falta dágua, atendimento médico, buracos nas ruas, lixo e salário de servidores atrasados.
A promotora disse que achou exemplar o despacho do juiz Simeão Pereira, ao condenar a prefeita. Disse doutor Simeão que a prefeita Socorro Waquim agia como quem tem certeza da impunidade.
O juiz determinou o afastamento da prefeita mas isto só vai ocorrer seu o Tribunal de Justiça tiver “a sensibilidade que teve o juiz Simeão Pereira”, segundo a promotora Selma.
Neste ponto Socorro Waquim está traquila. Não foi à toa que ela obrigou mais de 11 mil timonenses a votar num desconhecido Edilásio Junior, que é genro da desembargadora Nelma Sarney. Não por acaso que a preclara (sic) desembargadora, ao julgar mais um pedido de afastamento de Socorro Waquim, classificou como “fumu bonus juris” – no popular “só fumaça” – a ação movida pelo promotor Eduardo Borges.
Até o Conselho Nacional de Justiça tomar conhecimento de sua atuação política no Tribunal de Justiça do Maranhão.

O Tribunal de Justiça do Maranhão manteve a decisão do juiz da 4ª Vara de Timon, Simeão Pereira e Silva que decidiu pela permanência de Socorro Waquim no cargo de prefeita da cidade.
O pedido inicial de afastamento da prefeita do cargo foi feito pelo promotor Eduardo Borges que alegou atraso de salário dos servidores e má gestão dos recursos públicos.
Com a negativa do juiz local, a promotora Selma Regina Martins recorreu para o TJ onde apresentou um Agravo de Instrumento com o mesmo pedido, entretanto retirando o nome da Secretária Municipal de Educação, Sueli Almeida, pois aquela pasta já estaria com o pagamento dos funcionários em dia.
A decisão do TJ pela permanência de Socorro Waquim no cargo foi proferida pela desembargadora Nelma Sarney(foto acima) no último dia 23 (segunda-feira passada). Uma das alegações da desembargadora foi a ausência do “fumus boni iuris”, o que no direito representa a falta de pressupostos convincentes para o objetivo da ação judicial.

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
